Terms of Service

Welcome to Casa Olmo. These Terms of Service ("Terms") govern your use of the website casaolmotx.com (the "Site") and your purchase of food from ViGe Foods LLC, doing business as Casa Olmo ("Casa Olmo," "we," "us," or "our"), an Austin, Texas company. By using the Site or placing an order with us, you agree to these Terms.

1. Our Services

Casa Olmo operates a kitchen in Austin, Texas, preparing breakfast, lunch, and dinner selections and baked goods for takeout by pre-order, including large and custom orders. Delivery may be available for large orders by separate arrangement. We also offer food service transport — moving catering equipment, prepared food, and related supplies between locations — quoted per job. For transport jobs, the customer is responsible for accurately describing the load and ensuring items are properly packed and ready at the agreed pickup time; Casa Olmo is not responsible for damage to items that were improperly packed by the customer. All orders are subject to availability, confirmation, and required lead times, which vary with order size.

2. Quotes, Orders, and Payment

Quotes provided through the Site or by email are estimates and are not binding until confirmed in writing by Casa Olmo.
An order is confirmed only when we have accepted it in writing and any required deposit or payment terms have been agreed.
Prices are subject to change until an order is confirmed. Applicable Texas state and local sales taxes will be added where required by law.
Payment terms, deposits, and accepted payment methods are stated on your invoice or order confirmation.

3. Cancellations and Changes

Because food is prepared fresh for your event, cancellations and changes to headcount, menu, or delivery time must be requested in advance. Specific cancellation windows and any applicable fees will be stated in your order confirmation. Orders canceled after food production has begun may be charged in full.

4. Pickup and Delivery

Takeout orders are picked up from our kitchen at the agreed time; orders not collected within a reasonable window may be charged in full. Where delivery is arranged, delivery times are estimates made in good faith. We are not responsible for delays caused by events outside our reasonable control, including traffic, weather, or building access issues. Please ensure we have accurate delivery instructions and site access; if delivery cannot be completed due to inaccurate information or inaccessibility, the order may still be charged.

5. Food Safety and Allergens

Allergen notice: Our food is prepared in a kitchen that handles common allergens, including milk, eggs, wheat, soy, peanuts, tree nuts, fish, shellfish, and sesame. While we take care with dietary requests and labeling, we cannot guarantee any item is completely free of allergens or cross-contact. Guests with severe allergies should exercise their own judgment.

Food is prepared ready to serve. Once an order is picked up or delivered, the customer is responsible for proper handling, holding temperatures, and timely service of the food. We recommend perishable items be served promptly and not held at room temperature beyond food-safety guidelines.

6. Intellectual Property

The Site and its contents — including the Casa Olmo name, logo, text, and images — are owned by ViGe Foods LLC and protected by applicable law. You may not use our marks or content without our prior written permission.

7. Disclaimer of Warranties

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, and non-infringement. This does not affect any non-waivable rights you have regarding food products under applicable law.

8. Limitation of Liability

To the fullest extent permitted by law, Casa Olmo's total liability arising out of or relating to an order shall not exceed the amount you paid for that order, and we shall not be liable for indirect, incidental, special, or consequential damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or our services shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

10. Changes to These Terms

We may update these Terms from time to time. The "Effective" date above reflects the latest revision. Continued use of the Site or our services after changes take effect constitutes acceptance of the revised Terms.
